Upon hiring me for my services, you are entering into an agreement with Quirki Website Design. You agree with and will adhere to these following policies:
Feedback & Content
It is the responsibility of the Client to provide any and all feedback and written content for the website, which is to be provided within a reasonable timeframe.
Once the Client is presented with the first draft, feedback on the design and written content for the website will be requested. If either is not provided within 30 days of the request without prior agreement of both parties, the website will be filled with placeholder text, the website will be available for publishing as-is, and the Client will be responsible for the editing of the content. The Client forfeits any further work, the contract is to be considered fulfilled and no moneys are to be refunded.
The addition of pages or changes to content after submission are of the responsibility of the Client (addition of text, changes to wording, text formatting, etc.). Quirki Website Design will provide direction on how to make these changes and can be done so easily by the Client through the WordPress Content Management System.
Website Maintenance
WordPress is a user-friendly Content Management System that you will be able to navigate with ease. You will be able to add pages, make changes to text (including the addition of images), add links to the menu bar and manage content in various areas of your website. Making changes to certain areas of the website may be an advanced level task (changes to framework and design) so be sure to request these changes during the Feedback phase of the process or they will be considered an additional charge. You will be provided with instructions on how to edit your Website.

Security
The security of the website is the Client’s responsibility. Security measures have been put in place but there are always risks of being hacked; it has happened to some of the biggest companies. To ensure your website is secure, it is recommended to keep your passwords in a safe place, change them frequently and use a variety of characters. Quirki Website Design will hold a copy of their website upon publishing. In the event that the Client’s website is hacked, the Client may hire Quirki Website Design to restore it back to its original state when originally published live. The Client may also hire Quirki Website Design to back up their site regularly and to store their site backups. Quirki Website Design will not be held liable for any damages, including, but not limited to, the loss of data or profit, arising from a website hack.
Copyright, Licences & Usage
The Client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Quirki Website Design for inclusion in the Web Design Project are owned by the Client, or that the Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, indemnify and defend Quirki Website Design from any liability arising from the use of such elements furnished by the Client.
Websites created by Quirki Website Design are for the sole purpose of the website specified in this contract. Graphics and other creations are not to be sold or redistributed in any way, whether for monetary gain or any other purposes. Websites by Quirki Website Design are created using images that are either custom created or licensed from Stock Photo websites in line with their respective policies. Websites built on a WordPress platform are open source, and are governed by GPL (General Public License). All website code is either custom written, or is borrowed from other GPL code packs or themes.
Limitation of Liability
The Client agrees that they will defend, indemnify, save and hold Quirki Website Design completely harmless from any and all costs, loses, claims, demands and liabilities, including all attorney’s fees, as well as any errors, omissions and infringements arising from publication, dissemination and use of those materials I create for you, your company, your representatives and assigns, as well as any liabilities asserted against Quirki Website Design that may arise or result from any service offered, performed or agreed to be performed, or from any product or service sold by you, your company, your representatives or your assigns, in any way. Quirki Website Design does not guarantee any search engine position for the Client and the Client also acknowledges that the services offered are not the sole influences on the positioning of the Client on the internet search engines. Quirki Website Design will not be held liable for any non-inclusion, drop in position, decrease in website traffic or resulting loss of business, revenue or profits.
Dissatisfaction
In the event of dissatisfaction of the design, Quirki Website Design will do everything necessary, to a reasonable extent, to improve the design to the Client’s satisfaction. My experience and skillset allows for unlimited possibilities so there is no reason we can’t get the website to where you are completely satisfied!
Due to the nature of the service, hours spent on the project are irreversible and will have already been provided, therefore all payments are non-refundable. The demo provided serves a purpose in giving the Client a snapshot of what the final product will look like when complete. By approving the demo and allowing the site to be published to the web, the Client is claiming satisfaction of the design. It is the Client’s responsibility to provide detailed feedback in order to allow both parties to reach a desired final product. If no agreement can be met and the Client chooses to terminate the agreement, payment will be retained by Quirki Website Design and no refunds are to be given.
